Terms of Service

1. Introduction & Acceptance
These Terms of Service (“Terms”) govern your access to and use of the OctoSniff website, desktop software, web-based tools, and any related services (collectively, the “Service”). By creating an account, subscribing, downloading, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree, you must not access or use the Service.
2. Eligibility
You must be at least 18 years of age, or the age of majority in your jurisdiction, to use the Service.
3. Description of Service & Intended Purpose
OctoSniff is a network analysis and diagnostics tool designed exclusively for use on networks that you own, operate, or have explicit authorization to monitor. The software is intended for legitimate purposes including:
- Analyzing and optimizing your own home network performance.
- Diagnosing connectivity issues with your personal gaming setup.
- Educational use — learning about network protocols, packet structures, and traffic patterns.
- Testing and quality assurance of your own network configuration.
- Personal security auditing of devices connected to your own network.
OctoSniff is comparable to widely available network analysis tools such as Wireshark, tcpdump, and similar utilities. It is a diagnostic tool — how it is used is entirely the responsibility of the end user.
4. Accounts & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Each subscription is for a single user.
5. Subscriptions, Billing & Pricing
Access to the Service is provided through paid subscription plans. Subscriptions renew automatically each month. Payments are processed by third-party processors (e.g., Stripe). We may adjust pricing with at least 30 days’ advance notice.
6. Cancellation & Refunds
You may cancel your subscription at any time through your Client Panel. Upon cancellation, you retain access for the remainder of the current billing period.
Right of withdrawal (EEA/Norway): In accordance with the Norwegian Right of Cancellation Act (angrerettloven) and EU Directive 2011/83/EU, you have a 14-day right of withdrawal from the date of purchase. However, by accessing the digital Service immediately upon purchase, you expressly consent to waive this right once access has been granted.
7. Acceptable Use & User Responsibility
7.1 Authorized Use Only
You may only use the Service to capture, analyze, and inspect traffic on networks that you personally own, administer, or have received explicit written permission to monitor.
7.2 Lawful Purposes
You agree to use the Service exclusively for lawful purposes, including monitoring your own network, diagnosing connection issues, learning about network protocols, testing firewall rules, and auditing your own devices.
7.3 Prohibited Conduct
You expressly agree that you will not:
- Use the Service on any network you do not own or are not authorized to monitor.
- Use the Service to harass, threaten, stalk, dox, or otherwise harm any individual.
- Use any data obtained to conduct denial-of-service attacks, swatting, or any form of network abuse.
- Intercept, collect, or use personal data of third parties in violation of applicable privacy laws.
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code.
- Redistribute, sublicense, sell, or otherwise make the Service available to unauthorized third parties.
- Circumvent, disable, or interfere with any security, licensing, or access control features.
- Use the Service in connection with any illegal activity.
7.4 User Responsibility & Indemnity
You are solely and entirely responsible for how you use the Service and for ensuring that your use complies with all applicable laws. We do not endorse, encourage, or condone any illegal or unauthorized use.
8. Intellectual Property
All rights, title, and interest in the Service remain our exclusive property. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service solely for personal network analysis and diagnostics.
9. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis. We make no representations regarding the legality of using network analysis tools in your specific jurisdiction — you are solely responsible for determining whether your intended use is lawful.
10. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability shall not exceed the amount you have paid us in the twelve months preceding the event giving rise to the claim.
11. Indemnification
You agree to indemnify, defend, and hold us harmless from any claims arising from your use or misuse of the Service, use on unauthorized networks, violation of these Terms, or violation of applicable laws.
12. Termination
We may suspend or terminate your access at any time if we reasonably believe you have violated these Terms. Sections 7 through 14 survive termination.
13. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of Norway. Any dispute shall be subject to the exclusive jurisdiction of the Norwegian courts. EU consumers may submit complaints through the EU Online Dispute Resolution platform.
14. Changes to These Terms
We reserve the right to modify these Terms. Material changes will be communicated at least 30 days before they take effect.
15. Severability
If any provision is found invalid or unenforceable, the remaining provisions continue in full force.
